Understanding the Role of the Expert Witness

In the our adversarial-style legal system, witnesses with specialized training are allowed to testify at criminal or civil proceedings; and offer their expert opinions regarding facts in issue. When the defence/ prosecution offers questionable expert testimony, inconsistencies can be addressed by offering an expert of equal experience, training, and credibility; to rebut prior testimony, and provide the judge/jury with a more accurate interpretation of the evidence presented. An expert witness, by virtue of their focused education, training, skill and experience, is believed to have valuable knowledge; relating to a specific subject, beyond that of the average person. It has also been determined that an expert witness has sufficient education and experience, to encourage fact finders to rely upon their educated opinion; when determining the weight of evidence, or explore questionable facts in issue. Expert witnesses may also be called upon to deliver evidence regarding facts, relating to their own expertise. Sometimes referred to as a “professional witness”, experts are often relied upon for professional opinions; regarding the: severity of an injury, degree of insanity, cause of failure in a machine/device, loss of earnings, cost of care; and much, much more. In some cases, a presiding judge will call upon expert witnesses to professionally evaluate a particular fact or action in question; and provide the court with a complete understanding. The expert testimony offered by a professional witness is then compared to that of the prosecution/defence experts; in hopes of providing a detailed and comprehensive awareness. Although expert witnesses can testify in any legal proceeding in which their expertise is relevant, criminal cases are more likely to use forensic scientists or forensic psychologists. S. Court must satisfy the specific requirements of the Federal Rules of Evidence. Under Rule of Evidence number 702, an expert is defined as a person with scientific, technical, or other specialized knowledge; who can provide assistance to the trier of fact, whether it be judge/jury. A qualified expert may testify in the form of their opinion or otherwise, so long as: the testimony is based upon sufficient facts or data, the testimony is the product of reliable principles and methods, and the expert witness has applied the principles and methods reliably to the facts of the case.
